Guilty of sodomy, officer gets gate

NELLINGEN, West Germany (P) A U.S. Army court martial has convicted a Green Beret officer of violating the military's antisodomy statute by committing homosexual acts with an enlisted soldier in a barracks in Bavaria.

The civilian defense lawyer for Lt. Joseph G. Hatheway Jr., 26 of Santa Barbara, Calif., said yesterday that Hatheway was ordered dismissed from the Army with the loss of all veterans' benefits after his conviction Friday by an eightofficer JURY.

Christopher Coates, the lawyer. said Hatheway has been reassigned to Robinson Barracks in Stuttgart, West Germany, while the sentence is confirmed by Army authorities. He had faced a maxi-

mum sentence of five years at hard labor.

During the court martial, Hatheway testified he had a history of "alcoholic blackouts" and could not recall the incident last July 31 at the enlisted mens' barracks of the Special Forces post in Bad Toelz, West Germany.

Pfc. Robert C. Lynde, a government witness given immunity for testifying against Hatheway, said the officer made sexual overtures toward him during a drinking bout and they committed acts of sodomy together.

Coates said he would appeal the verdict to the Court of Military Appeals in Washington but a ruling would take at least a year.
